1. Data controller

2. What data we process and why

• Data you send us through the form, email, phone or WhatsApp (name, email, phone and your enquiry), to reply to you and, if you ask, prepare a proposal.
• Client data, to provide the services you hire, such as company formation, accounting and tax, and to meet the related legal obligations.

3. Legal basis

Your consent when you send an enquiry; the performance of a contract or pre contractual steps when you request a proposal or hire a service; and compliance with legal obligations, in particular tax, company law and anti money laundering rules.

4. How long we keep your data

Enquiries that do not lead to a contract are kept for up to one year. Client data is kept for the duration of the relationship and afterwards for the periods required by law.

5. Who receives your data

We do not share your data with third parties except where required by law or needed to provide the service (for example notaries, the Mercantile Registry or the Spanish Tax Agency). We use providers who process data on our behalf: Cloudflare, for website hosting, and FormSubmit, for the contact form. Some of them may process data outside the European Economic Area, with the safeguards required by the GDPR. The website loads fonts from Google Fonts, which means your browser shares its IP address with Google.

You can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to javier.mohino@setupacompanyinspain.com. You may also complain to the Spanish Data Protection Agency (www.aepd.es).
